Judge says Missouri gas tax question can stay on ballot

A judge in Osage County dismissed a lawsuit on Tuesday.

The lawsuit was supposed to stop voters from deciding whether to raise the gas tax.

Rep. Mike Moon, R-Ash Grove, and activist Ron Calzone filed a lawsuit arguing the Legislature took parliamentary shortcuts in approving a referendum. This referendum would phase in a 10-cent increase in the state’s motor fuel tax over four years.
